Website Terms, Customer Disclosures and Policies

These Terms govern the use of the VOLTRIX Inc. website and any automotive product or service requested, purchased or arranged through VOLTRIX Inc. By using this website, submitting an application, authorizing a transaction or making a payment, the customer agrees to these Terms.

1. About VOLTRIX Inc.

VOLTRIX Inc. operates as an independent automotive-services platform and connector. We assist customers in locating and accessing automotive products and services offered by independent dealerships, warranty administrators, insurers, lenders, repair facilities and other third-party providers.

Unless expressly identified in a signed agreement, VOLTRIX Inc. is not:

  • The seller or owner of a vehicle;
  • A motor-vehicle dealership;
  • A vehicle manufacturer;
  • An insurance company;
  • A lender;
  • A repair facility; or
  • The administrator responsible for approving warranty claims.

VOLTRIX Inc. is not affiliated with or endorsed by OMVIC. Nothing in these Terms excludes any regulatory oversight or consumer right that applies by law.

2. Independent Third-Party Providers

Products and services made available through VOLTRIX Inc. may be supplied, administered, insured, financed or fulfilled by independent third parties.

The applicable provider remains responsible for administering its product, reviewing claims, authorizing repairs, making lending decisions and fulfilling its contractual obligations.

VOLTRIX Inc. may receive a fee, commission or other compensation for arranging or facilitating a product or service.

3. Warranty and Protection Products

Warranty descriptions displayed on this website are general summaries only and do not replace the customer’s issued warranty agreement.

Actual coverage is determined by the final agreement, including its:

  • Covered components;
  • Exclusions;
  • Deductibles;
  • Claim limits;
  • Waiting periods;
  • Pre-existing-condition provisions;
  • Maintenance obligations;
  • Time and kilometre limitations;
  • Repair-facility requirements; and
  • Claim-authorization procedures.

Coverage is not active merely because a quote was requested or a payment was initiated. Activation must be confirmed through an issued policy, warranty agreement, certificate or written confirmation from the applicable provider.

VOLTRIX Inc. does not guarantee that a particular repair or claim will be approved. Claim decisions are made according to the provider’s agreement and authorization process.

4. Customer Authorization

By requesting or purchasing a product or service through VOLTRIX Inc., the customer:

  • Confirms that all submitted information is complete and accurate;
  • Authorizes VOLTRIX Inc. to process the request;
  • Authorizes VOLTRIX Inc. to submit necessary information to the selected provider;
  • Authorizes reasonable communication with relevant dealerships, insurers, lenders, administrators and service facilities;
  • Acknowledges that third-party approval may be required;
  • Agrees to review all documents received; and
  • Agrees to report any discrepancy promptly.

The customer must not submit false, altered, incomplete or misleading information.

5. Pricing and Taxes

All prices are stated in Canadian dollars unless otherwise indicated.

Applicable taxes, including HST, will be disclosed before the transaction is completed. Quotes are based on the information available when issued and may change if vehicle information, eligibility, provider pricing or requested coverage changes.

Customers will be asked to authorize any material price change before VOLTRIX Inc. proceeds.

Obvious typographical, calculation or system errors may be corrected before a transaction is completed. If an error affects a completed transaction, VOLTRIX Inc. will contact the customer to arrange an appropriate correction consistent with applicable law.

6. Payments and Processing

A payment authorizes VOLTRIX Inc. to begin processing the selected product or service.

Processing may include:

  • Reviewing the customer’s information;
  • Preparing or submitting an application;
  • Communicating with providers;
  • Registering or issuing coverage;
  • Paying provider or administrative costs; and
  • Preparing customer documentation.

The customer agrees to pay all amounts authorized under the applicable agreement and payment schedule.

7. Cancellations and Refunds

Payments become non-refundable once the selected warranty or service has been submitted, issued, activated or delivered to the customer, except where a refund is required by applicable law or expressly permitted under the provider’s agreement.

If a cancellation request is received before vehicle delivery and before the warranty or service has been submitted, issued or activated, VOLTRIX Inc. may consider a refund based on the circumstances.

Any approved refund may be reduced by previously disclosed processing fees and legitimate non-recoverable expenses already incurred, where permitted by law.

Submitting a cancellation request does not guarantee a refund. Each request will be reviewed individually based on:

  • The transaction status;
  • Supporting records;
  • Work already performed;
  • Amounts already remitted;
  • Provider cancellation terms; and
  • Applicable law.

A cancellation request does not automatically suspend an authorized payment obligation. Any unpaid contractual balance remains payable unless the customer receives written confirmation stating otherwise.

Nothing in this policy removes or limits a consumer right that cannot lawfully be waived.

8. How to Request Cancellation

Cancellation requests must be submitted in writing to:

The request should include:

  • The customer’s full legal name;
  • Vehicle year, make and model;
  • Vehicle identification number;
  • Policy or agreement number;
  • Reason for cancellation; and
  • Relevant supporting documents.

Cancellation becomes effective only after written confirmation from VOLTRIX Inc. or the applicable provider.

9. Vehicle Listings and Inventory

Vehicle listings may originate from independent dealerships, sellers or other authorized inventory sources.

Unless expressly stated in writing, VOLTRIX Inc. does not own the listed vehicle and is not the selling dealership.

Vehicle availability, mileage, history, ownership, condition, equipment and pricing must be confirmed with the applicable seller before purchase.

Listings may be updated, changed or removed without notice if a vehicle is sold, withdrawn or no longer available.

VOLTRIX Inc. does not guarantee the accuracy of information supplied by an independent seller, but will make reasonable efforts to correct confirmed errors.

10. Vehicle Purchase and Inspection

Customers are responsible for reviewing the final bill of sale and all vehicle disclosures provided by the selling dealership or owner.

Customers should complete an independent inspection, review the vehicle history and confirm all material information before purchasing a vehicle.

VOLTRIX Inc. does not guarantee the condition, safety, roadworthiness or future performance of a vehicle unless such a guarantee is expressly provided in a separate signed agreement.

11. Financing and Credit Applications

Submitting a request, consent form or credit application does not guarantee:

  • Financing approval;
  • A particular interest rate;
  • A specific payment amount;
  • A specific lender;
  • Vehicle availability; or
  • Completion of a transaction.

Financing decisions are made by independent lenders according to their own criteria.

Where authorized, VOLTRIX Inc. may transmit customer information and supporting documents to lenders or authorized financing partners for assessment.

12. Insurance Information

Where the customer authorizes it or where reasonably required to administer the selected service, VOLTRIX Inc. may provide relevant warranty or vehicle information to the customer’s insurer, dealership or service provider.

VOLTRIX Inc. does not provide insurance advice and does not guarantee how an insurer will classify or respond to a warranty or protection product.

13. Repairs and Claims

Customers must follow the claim process stated in the issued warranty agreement.

Unless the agreement expressly states otherwise, customers should not authorize or begin a repair before receiving the required provider authorization.

VOLTRIX Inc. is not responsible for unauthorized repairs, excluded components, pre-existing conditions, maintenance failures or expenses that fall outside the issued agreement.

14. Electronic Communications

Customers authorize VOLTRIX Inc. to send transactional communications reasonably necessary to:

  • Respond to inquiries;
  • Process applications;
  • Confirm payments;
  • Provide documents;
  • Administer purchased services;
  • Schedule appointments; and
  • Address account or coverage matters.

Transactional communications may continue when necessary even if the customer withdraws consent to receive promotional messages.

15. Marketing Communications

Promotional emails and text messages will be sent only where permitted by law.

Customers may withdraw marketing consent at any time by:

  • Using the unsubscribe option provided in the message;
  • Replying “STOP” to an eligible text message; or
  • Emailing [email protected].

Withdrawing marketing consent will not affect an existing purchase, application, warranty or required transactional communication.

16. Privacy and Personal Information

VOLTRIX Inc. may collect personal information such as:

  • Name;
  • Contact information;
  • Address;
  • Vehicle information;
  • Driver’s licence or identification;
  • Insurance information;
  • Financial or credit-application information;
  • Transaction records;
  • Communications; and
  • Website or device information.

Information will be collected, used and disclosed only for identified and reasonable purposes, including:

  • Responding to requests;
  • Preparing quotes;
  • Processing applications;
  • Arranging products and services;
  • Verifying identity;
  • Preventing fraud;
  • Communicating with providers;
  • Maintaining business records; and
  • Meeting legal or regulatory requirements.

VOLTRIX Inc. will use reasonable administrative, technical and physical safeguards to protect personal information against unauthorized access, loss, disclosure, alteration or misuse.

Customers may request access to or correction of their personal information by contacting [email protected].

VOLTRIX Inc. will retain information only as long as reasonably required for the identified purpose, contractual obligations, dispute management and legal recordkeeping.

17. Cookies and Website Analytics

The website may use cookies and analytics technologies to operate the website, remember preferences, measure performance, prevent fraud and understand how visitors use the platform.

Where required, users will be given appropriate notice or choices concerning non-essential tracking technologies.

18. No Professional Advice

Website content is provided for general informational purposes.

VOLTRIX Inc. does not provide legal, tax, insurance, mechanical or financial advice. Customers should obtain independent professional advice when necessary.

19. Website Availability

VOLTRIX Inc. does not guarantee that the website or any digital service will always be uninterrupted, error-free or available.

The website may be temporarily unavailable because of maintenance, technical issues, security concerns or circumstances beyond VOLTRIX Inc.’s reasonable control.

20. Intellectual Property

The VOLTRIX name, branding, website content, graphics, processes, designs and original materials are owned by or licensed to VOLTRIX Inc.

Users may not copy, reproduce, distribute, sell, modify or commercially exploit this material without written authorization.

21. Prohibited Conduct

Users must not:

  • Submit false or fraudulent information;
  • Attempt unauthorized access to the website or customer accounts;
  • Interfere with website security;
  • Use the platform for unlawful activity;
  • Impersonate another person;
  • Copy or misuse confidential information; or
  • Violate the rights of VOLTRIX Inc., a provider or another customer.

VOLTRIX Inc. may suspend access where reasonably necessary to protect customers, providers, the platform or the integrity of a transaction.

22. Limitation of Liability

To the maximum extent permitted by law, VOLTRIX Inc. is not responsible for:

  • Decisions made by independent providers;
  • A provider’s denial or limitation of a claim;
  • A lender’s financing decision;
  • A third party’s delay or failure to perform;
  • Inaccurate information supplied by a customer, seller or provider;
  • Vehicle defects, repairs or maintenance;
  • Loss caused by unauthorized repairs;
  • Loss of availability of a listed vehicle; or
  • Indirect, incidental, special or consequential losses.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct or a non-waivable statutory obligation.

23. Indemnification

To the extent permitted by law, a user agrees to indemnify VOLTRIX Inc. against claims, losses or expenses arising from:

  • False information submitted by the user;
  • Fraudulent or unlawful conduct;
  • Unauthorized use of another person’s information;
  • Violation of these Terms; or
  • Infringement of another person’s rights.

This section does not require a consumer to indemnify VOLTRIX Inc. for VOLTRIX Inc.’s own unlawful conduct, negligence or breach of a non-waivable obligation.

24. Complaints and Dispute Resolution

Customers should first submit a written complaint to:

VOLTRIX Inc. will review the complaint and supporting records in good faith.

These Terms do not prevent a customer from contacting an applicable provider, regulator, consumer-protection authority or court.

25. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada.

Any legal proceeding may be brought before a court with lawful jurisdiction. Nothing in these Terms prevents a consumer from exercising a statutory right or remedy.

26. Severability

If any portion of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

27. No Waiver

A delay or failure by VOLTRIX Inc. to enforce a provision does not waive the right to enforce that provision later.

28. Changes to These Terms

VOLTRIX Inc. may update these Terms prospectively.

The version accepted by the customer when completing a transaction will govern that transaction unless the customer and VOLTRIX Inc. agree otherwise in writing or a change is required by law.

29. Electronic Acceptance

Electronic acceptance, including clicking an acceptance box, signing electronically, replying with written approval or making an authorized payment, may be retained as evidence of the transaction.

Before payment, the customer should be required to confirm:

“I have reviewed the product description, total price, applicable taxes, payment schedule, provider information and cancellation terms. I authorize VOLTRIX Inc. to process my request and share the information reasonably required to arrange the selected product with the applicable third-party provider. I understand that refund eligibility may change once processing begins or coverage is submitted, issued or activated, subject to the provider agreement and applicable law.”

Marketing consent must be requested separately and must not be pre-selected.
